These Terms of Service (“Terms”) are a legally binding agreement between you and Truepicks, LLC (“Truepicks,” “we,” “us,” or “our”) regarding your access to and use of the Ghost mobile application, related websites including https://www.joinghostapp.com (the “Website”), and any associated services, features, or content (collectively, the “Services”).
BY USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
Prohibited Use: A2P Messaging
Ghost App is intended solely for conversational, person-to-person (P2P) communications between individual end users. Application-to-person (A2P) messaging, including but not limited to bulk messaging, marketing campaigns, automated alerts, mass solicitations, political messages, and any other non-conversational traffic, is strictly prohibited. Any use of the Service for A2P purposes, whether direct or indirect, will result in immediate suspension or termination of your account without refund. We reserve the right to monitor message patterns to ensure compliance and to take appropriate action if prohibited activity is detected.
1. Scope of License
1.1 We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Ghost app and Services on your personal devices. This license does not include distribution, resale, or commercial use beyond personal, lawful activity.
1.2 All content, software, trademarks, and intellectual property associated with the Services are owned by Truepicks or its licensors. You may not reproduce, distribute, or modify any part of the Services without express written permission.
1.3 Feedback you provide may be used by Truepicks to improve the Services. We own all rights in such feedback.
2. Restrictions
2.1 You may not:Reverse-engineer, decompile, or copy the app or its contents; Use the app for illegal, fraudulent, or abusive purposes; Engage in mass messaging, auto-dialing, spam, or impersonation; Use the app for call centers, emergency services (e.g., 911), or commercial broadcasting; Attempt to overload our servers or disrupt service to other users.
2.2 Any violation may result in immediate termination of your access.
2.3 Ghost is intended for person-to-person communication only. You are solely responsible for your behavior and content while using the Services.
2.4 This app is not a substitute for your regular phone service and does not support 911 or emergency calling. Do not use Ghost in emergency situations.
3. Accounts and Passwords
You are responsible for maintaining the confidentiality of your account credentials. Notify us at support@joinghostapp.com if you suspect unauthorized use.
4. Privacy and Data Use
Your use of the Services is subject to our Privacy Policy: https://www.joinghostapp.com/privacy-policy-official.
You agree not to misuse or collect personal data via the Services without proper legal basis, including GDPR compliance if applicable.
5. Termination
We may suspend or terminate your access to the Services at any time and for any reason, including violations of these Terms or applicable law. Upon termination, your rights under these Terms will cease immediately.
6. No Warranty
THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRUEPICKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED FIFTY U.S. DOLLARS ($50.00).
8. Intellectual Property
All trademarks, logos, and content associated with Ghost are the property of Truepicks or its licensors and may not be used without permission.
9. Indemnification
You agree to indemnify and hold harmless Truepicks, its affiliates, and personnel from any claim or demand due to your use of the Services, violation of these Terms, or infringement of any rights.
10. Availability & Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, including pricing, credits, or access. We are not liable for service interruptions or content errors.
11. Credits & Purchases
All payments are final. No refunds or exchanges unless required by law.Paid credits do not expire, but we may deactivate accounts inactive for 12+ months.Promotional or free credits may expire after 6 months.
12. Jurisdiction
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. You agree to exclusive jurisdiction in the courts of Florida for any dispute.
13. Waiver & Severability
Failure to enforce any provision does not waive the right to enforce it later. If any provision is found unenforceable, the remaining terms remain valid.
14. Assignment
You may not transfer your rights under these Terms. We may assign our rights without restriction.
15. Notices
Official communications will be sent via email or posted to our Website.
16. Changes to Terms
We may revise these Terms at any time. If changes are material, we will provide notice via our Website. Continued use of the Services after such changes means you accept the updated Terms.
17. Third-Party Links & Content
The Services may contain third-party links. We are not responsible for third-party content, services, or policies.
18. Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and Truepicks regarding the Services, superseding all prior agreements.
19. Electronic Document
This electronic document will be deemed a “writing” and enforceable as a signed agreement under all applicable laws.
